Washington Code Council Delays New Energy Code Until At Least October 29

In response to a May 25 lawsuit filed by the Building Industry Association of Washington (BIAW), Gov. Christine Gregoire requested that the State Building Code Council (SBCC) delay implementation of the 2009 Washington State Energy Code (WSEC), which was originally scheduled to take effect July 1, 2010.

On June 11, the SBCC unanimously passed two motions:

  1. Use its emergency rulemaking power to delay implementation until at least October 29, 2010
  2. Begin its regular rulemaking process to determine whether implementation should be further delayed until no later than April 1, 2011.

Public hearings will be held September 10 and October 15 to take testimony on the final implementation date.
